Assumption of risk, release of liability, waiver of claims and indemnity agreement
This is a legally binding agreement between the participant named below (the “Participant”) and Pure Life Martial Arts, 800 N Miramar Ave, Indialantic, Florida 32903. Read all of it before signing. If the Participant is under 18 years of age, a parent or legal guardian must read and sign it on the Participant's behalf.
1. Activities covered
This agreement covers all activities at or arranged by the academy, on or off the premises: Brazilian Jiu Jitsu (gi and no-gi), kickboxing, boxing, capoeira, women's self defense, kids classes, open mat, private lessons, seminars, gradings, strength and conditioning, and travel to or participation in competitions and events.
2. Assumption of inherent risks
The Participant understands that martial arts are contact activities and are inherently dangerous. Risks include, and are not limited to: bruises, cuts, abrasions, mat burn and skin infection; sprains, strains, dislocations and torn ligaments; broken bones and dental injury; joint damage from locks and submissions; loss of consciousness from chokes or impact; concussion and other head, neck and spinal injuries, including paralysis; heat exhaustion, cardiac events; permanent disability; and death. These risks arise from the nature of the activity itself, from the Participant's own actions, from the actions or inaction of instructors and training partners, and from the condition of the premises and equipment. The Participant knowingly and freely assumes all such risks, both known and unknown, and accepts personal responsibility for any resulting harm.
3. Release and waiver of claims
In consideration of being permitted to participate, the Participant releases, waives and discharges Pure Life Martial Arts, its owners, officers, instructors, coaches, employees, volunteers, training partners, landlords and the owners of the premises (together, the “Released Parties”) from any and all claims, demands, actions, causes of action, losses, costs and expenses of any kind — including those arising from the ordinary negligence of the Released Parties — for any injury, disability, death, or loss of or damage to property suffered in connection with the activities described above. The Participant agrees not to sue the Released Parties on account of any such claim. This release does not extend to conduct that is grossly negligent, intentional, reckless, or otherwise incapable of being released under Florida law.
4. Indemnity
The Participant agrees to indemnify and hold the Released Parties harmless from any loss, liability, damage, claim or cost, including reasonable attorneys' fees, arising out of the Participant's conduct during the activities, or brought by or on behalf of the Participant in breach of this agreement.
5. Physical condition and medical treatment
The Participant confirms that they are in good physical health, are not aware of any medical condition that would make participation unsafe, and have disclosed any condition, injury, allergy or medication that instructors should know about. The Participant is solely responsible for their own fitness to train and should consult a physician before beginning. The Participant consents to first aid and, in an emergency, to being transported for and receiving medical treatment, and accepts financial responsibility for the cost of that treatment. The academy does not provide accident or health insurance for participants.
6. Hygiene, illness and communicable disease
Close-contact training carries a risk of transmitting skin conditions and communicable illnesses. The Participant agrees to train with short clean nails, in clean attire, to cover open wounds, to disclose any contagious skin condition, and to stay off the mats while contagious. The Participant assumes the risk of exposure to communicable disease arising from participation.
7. Rules, conduct and instruction
The Participant agrees to follow all academy rules, to obey instructors' directions, to train within their ability and their partner's, to release a submission immediately when a partner taps or signals, and to treat everyone on the mats with respect. Martial arts techniques taught here are for training, sport and lawful self defense only. The academy may suspend or end participation for unsafe or abusive conduct.
8. Photography and media
The academy may photograph or film classes, gradings and events, and may use that material to promote the academy. If the Participant does not wish to appear in such material, they may tell the academy in writing at any time and the academy will not use new material in which they appear.
9. Personal property
The academy is not responsible for loss of or damage to personal property brought onto the premises.
10. Governing law, venue and severability
This agreement is governed by the law of the State of Florida, and any action relating to it shall be brought in the state courts sitting in Brevard County, Florida. If any part of this agreement is held unenforceable, the remainder stays in full force and shall be construed to give the greatest effect the law allows. This agreement binds the Participant and their heirs, assigns, personal representatives and next of kin.
Notice to the minor child's natural guardian — required by Florida law
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF PURE LIFE MARTIAL ARTS USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM PURE LIFE MARTIAL ARTS IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD RESULTING FROM THE RISKS INHERENT IN THE ACTIVITY OR RESULTING FROM PURE LIFE MARTIAL ARTS' NEGLIGENCE.
11. Acknowledgment
The signer confirms that they have read this entire agreement, that they understand it is a release of liability and a contract between them and the academy, that they sign it freely and without inducement, and that they intend their electronic signature below to have the same effect as a handwritten one.
